TERMS OF SERVICE

These Terms of Service govern your use of the Fancy Pets Planet website, services, and purchases. By accessing this website, visiting our Florida location, or purchasing any animal or service from Fancy Pets Planet LLC (“Seller”), you agree to be bound by the following terms and conditions.

1. Governing Law & Jurisdiction

All transactions, agreements, and disputes arising from purchases made through Fancy Pets Planet LLC, whether in-state or out-of-state, shall be governed by and construed in accordance with the laws of the State of Florida.

Any legal action, claim, or proceeding shall be brought exclusively in Miami-Dade County, Florida. By purchasing from Seller, Buyer consents to personal jurisdiction in the State of Florida.

2. General Sales Terms

All sales are subject to availability. Seller reserves the right to correct errors in pricing or availability and may cancel orders where necessary.

Prices displayed do not include applicable sales tax. Florida sales tax will be applied where legally required.

All animal purchases require execution of a separate legally binding Purchase Agreement, which governs health guarantees, ownership terms, and responsibilities.

3. Breed Development & Size Estimates

Buyer acknowledges that Toy and Miniature Poodles are selectively bred companion animals, and as with all selectively bred dogs, precise adult size and structural development cannot be guaranteed.

Size projections are estimates based on:

• The Puppy’s current age and weight
• Parental size and lineage
• Pedigree history
• Breeder experience

However, biological development varies between individuals. Final adult height, weight, coat texture, color intensity, and structural traits may differ from early-stage expectations.

Unless expressly stated in a written Purchase Agreement, Seller does not guarantee:

• Exact adult height or weight
• Conformation for show competition
• Teeth alignment or bite development
• Ear set, coat texture, or color retention
• Testicle descent
• Future breeding ability

This clause is not intended to diminish quality, but to clarify that development is influenced by genetics and maturation beyond Seller’s control.

4. Imported Puppy / Third-Party Breeder Disclosure

In certain transactions, Seller acts as a reseller and is not the original breeder of the Puppy. Such Puppies are bred by independent third-party breeders and imported into the United States by the Breeder or its authorized agent.

Seller’s responsibility is limited to:

• Careful selection of reputable breeders
• Proper care and supervision of the Puppy after receipt
• Disclosure of documentation provided by the Breeder

Seller does not make independent guarantees regarding genetic predispositions, long-term hereditary traits, or breeder-origin health conditions beyond documentation provided and disclosed at the time of sale.

5. Limitation of Representations

Except as expressly stated in a signed Purchase Agreement, Seller makes no warranties regarding exhibition results, championship titles, breeding success, or future physical development.

6. Interstate Transactions

For out-of-state Buyers, title and responsibility transfer in accordance with the signed Purchase Agreement. Buyer acknowledges that Seller’s obligations are limited to the terms expressly stated in the executed contract and applicable Florida law.

7. Grooming Services

Grooming estimates are subject to adjustment based on coat condition and required handling time. Seller is not responsible for pre-existing skin conditions, matting-related irritation, or behavioral incidents during grooming.

8. Intellectual Property

Unauthorized use may result in legal action.
